Exam Gorilla Terms of Use
These terms are the agreement between you and Sphnix, Inc, 15833 Ibsen Pl, Dumfries, VA 22025, USA ("we", "us"), for using the Exam Gorilla iPhone app (the "app"). They also serve as the app's end-user license agreement (EULA). Please read them together with our Privacy Policy, which explains how information is handled.
The short version#
- You bring your own pages, and Exam Gorilla turns them into practice tests with AI. AI can make mistakes, so check anything important against your pages or your teacher.
- Only add documents you're allowed to use for your own study.
- Paid plans are sold by Apple and renew automatically until you cancel in your iPhone's Settings, at least 24 hours before the period ends.
- If a child uses the app, a parent or guardian should set it up and agree to these terms for them. Signing in, buying and deleting the account are for grown-ups.
- You can delete your account in the app at any time. That doesn't cancel a subscription; cancel it in your iPhone's Settings.
1. Accepting these terms#
By downloading or using the app you agree to these terms. If you don't agree, please don't use the app.
Children and parents. If you're under 18, or under the age of majority where you live, a parent or legal guardian must agree to these terms for you. A parent must also set up the app for any child under 13, or under the age of digital consent where the child lives. When a parent or guardian sets up the app for a child, the parent accepts these terms for the child and is responsible for the child's use of the app and for any purchases.
You also need to follow the Apple Media Services Terms and Conditions, which govern the App Store.
2. What Exam Gorilla does#
Exam Gorilla doesn't come with any study material. You add your own documents, such as PDFs, photos of pages, camera scans or text. You choose how many questions you want, how hard, and in what style. The app then creates a test from your pages and lets you take it, see your score and review your answers.
To write the questions, the app sends the pages you select to our server and our AI provider, Google Cloud Vertex AI (Gemini models), as described in the Privacy Policy. The app tells you before this happens and asks for permission. You need an internet connection to create new questions. Retakes and reviews of tests you already have work offline.
Advertising. The app shows no ads. We advertise Exam Gorilla on Facebook and Instagram and use Meta's tools in the app and on our website to measure those ads, as the Privacy Policy explains. You can say no to tracking on your phone and on our website.
Your account. The app creates a private account with a random user ID automatically, so that we can apply your free allowance and your plan. You don't need to give a name or email. A grown-up can choose to sign in with Apple, or with Google where offered, so that the plan and credits can be kept on a new phone. There's no password and no email sign-in link. Keep access to the Apple Account or Google account you sign in with secure, and use a grown-up's account, not a child's. You're responsible for what happens under your account. You can sign out or delete the account at any time in the app (see section 11).
3. AI-generated content: please read#
The questions, answers, hints, explanations and scores in Exam Gorilla are generated automatically by artificial intelligence from your pages.
- They may be wrong, incomplete or worded oddly, even though the app checks each answer against the sentence on your page that it came from.
- They're a study aid, not a substitute for your teacher, your textbook or official exam material.
- "Exam pattern" styles such as JEE, NEET, UPSC or SAT imitate the general format and marking of those exams. They're not official papers and don't predict real exam questions or results. These exams and their names belong to their owners, who haven't endorsed or partnered with Exam Gorilla.
- Scores, stars and "what to revise" suggestions are for practice only.
If you see a question that's wrong or inappropriate, please report it to hello@examgorilla.app or use the report option in the app. We read every report and use it to improve the app.
4. Your documents#
You own your documents. We don't claim any rights to the pages you add or the tests made from them.
You're responsible for having the right to use them. Only add material that you created, that you're allowed to use, or that you use for your own personal study as copyright law permits. Don't use the app to copy, distribute or sell other people's work.
Permission for us to process them. You give us, and our AI provider acting for us, permission to process the pages you select only as needed to create and check your questions and send them back to you. Our server doesn't keep your pages after the request is finished.
Your library is stored on your device. You're responsible for keeping your own copies, for example with the app's export option. Deleting the app or using Delete all data permanently removes the library from the phone.
5. Using the app fairly#
Please don't:
- add content that's illegal, or that's hateful, sexually explicit, violent or harmful to children
- try to get the AI to produce such content, or to bypass its safety measures
- copy, modify, reverse-engineer or resell the app, except where the law allows it
- try to get around your question allowance, create accounts to get extra free tests, interfere with our server, or access it except through the app
- use the app in a way that breaks the law or anyone else's rights
We may limit or stop the AI features, or suspend an account, for anyone who misuses them, for example by rate-limiting requests.
6. Plans, subscriptions and purchases#
The app has a free plan with a small number of tests each month. You can also buy paid options through Apple's In-App Purchase:
- Plus: an auto-renewing monthly or yearly subscription with a larger monthly question allowance and extra features. It may come with a free trial or an introductory price.
- Single quiz: a one-time purchase that lets you make one test, without a subscription. It doesn't renew.
The exact name, length, price, allowance and features of each option are shown in the app before you buy, and on the purchase sheet from Apple. Prices and plans can differ by country. What the app shows at the time of purchase is what applies. We may add other options later; if we do, the app will describe them before you buy.
Allowances. Plans are measured in tests and questions generated. Retakes and reviews of existing tests don't use up your allowance. A monthly allowance resets at the start of each calendar month, and unused questions don't carry over. A Single quiz credit is used only when a test is made successfully, and unused credits don't expire. Your plan, counts and credits are kept on our server with your account. If you haven't signed in and you delete the app or change phones, we may not be able to find your credits again, so we recommend signing in after you buy a Single quiz.
Auto-renewal. Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically at the same length and the price then in effect, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends. If the price of a subscription goes up, Apple will tell you beforehand and, where required, ask you to agree.
Free trials. If a plan includes a free trial, you won't be charged during the trial. When the trial ends, the subscription starts and you're charged automatically unless you cancel at least 24 hours before the trial ends. If you buy a subscription during a free trial, any unused part of the trial ends when you buy.
Managing and cancelling. You can manage or cancel subscriptions at any time: open Settings on your iPhone, tap your name (your Apple Account), then Subscriptions. You can also do this in the App Store. Cancelling stops the next renewal. You keep access until the end of the period you've paid for.
Refunds. Apple handles all payments and refunds. We can't issue refunds ourselves. You can request one from Apple at reportaproblem.apple.com. Apple's decision is final, apart from any rights you have under consumer law.
Restoring purchases. Use Restore purchases in the app to restore a Plus subscription on a new device signed in with the same Apple Account. A subscription follows the Exam Gorilla account that restored it last. Single quiz credits can't be restored through Apple; signing in to your Exam Gorilla account keeps them.
Parents: we recommend Apple's Family Sharing with Ask to Buy, so that a child can't make purchases without your approval.
7. Changes and availability#
We're always improving Exam Gorilla. We may add, change or remove features, change the AI models or AI provider we use (we'll update the Privacy Policy first), or change plans and prices for new purchases. If we make a change that significantly reduces what a paid plan includes during a period you've already paid for, we'll tell you in advance. You can then cancel, and you may ask Apple for a refund.
The app needs our server and our AI provider to create new questions. We work to keep them running, but they may sometimes be slow or unavailable. We may stop offering the app. If we do, we'll give reasonable notice in the app, and features that work on your device, such as your library and existing tests, will keep working as long as your iPhone runs them.
8. Our rights in the app#
The app, its design, the Exam Gorilla name and the Gogo mascot belong to us or our licensors. Under these terms you get a personal, non-exclusive, non-transferable and revocable license to use the app on Apple devices that you own or control, as the App Store Usage Rules allow. This includes devices shared through Family Sharing. Nothing else is transferred to you.
9. Disclaimers#
The app is provided "as is" and "as available". To the extent the law allows, we don't promise that it will be error-free or uninterrupted, or that AI-generated content will be accurate or suit a particular exam. We don't promise that using it will improve your marks.
Nothing in these terms limits rights you have under consumer protection law that can't be excluded. That includes, for example, the statutory rights of consumers in the EU, the UK, Australia and India.
10. Limitation of liability#
To the extent the law allows, we're not liable for indirect or consequential losses, such as lost data, lost profits or exam results. Our total liability to you for all claims about the app is limited to the amount you paid for the app and any in-app purchases in the 12 months before the claim.
We don't exclude or limit liability where that would be illegal, for example for death or personal injury caused by negligence, or for fraud.
11. Ending these terms#
You can stop using the app at any time by deleting it, and you can delete your account in the app with Me › Delete account. This deletes your account and the data our server keeps about it, as the Privacy Policy explains, including any unused Single quiz credits and remaining allowance. Remember to cancel any subscription in your iPhone's Settings, because deleting the app or your account doesn't cancel it. These terms end automatically if you break them in a serious way, and we may then close your account. If they end, you must stop using the app. Sections 3, 4, 8, 9, 10, 12 and 13 continue to apply.
12. Apple: required terms#
These terms are between you and us, not Apple. Because you get the app from the App Store, Apple requires the following:
- Agreement with us only. These terms are an agreement between you and Sphnix, Inc only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
- License scope. Your license to use the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts linked to the purchaser through Family Sharing or volume purchasing may also use it.
- Maintenance and support. We're solely responsible for any maintenance and support of the app, as described in these terms or as the law requires. Apple has no obligation to provide any maintenance or support for the app.
- Warranty. We're responsible for any product warranties, whether express or implied by law, to the extent they're not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any. To the maximum extent the law allows, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, not Apple's.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it. This includes (i) product liability claims, (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (iii) claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that the app, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging the claim.
- Legal compliance. You confirm that (i) you're not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you're not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about the app go to us: Sphnix, Inc, 15833 Ibsen Pl, Dumfries, VA 22025, USA, hello@examgorilla.app.
- Third-party terms. You must comply with any applicable third-party terms when using the app, for example the terms of your mobile carrier or internet provider.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Where these terms don't cover something, Apple's Licensed Application End User License Agreement applies. If the two conflict, these terms prevail, except for this section 12, which always applies as Apple requires.
13. Governing law and disputes#
These terms are governed by the laws of {{GOVERNING_LAW}}. If you live in a country whose consumer protection laws give you the right to bring claims in your local courts or under your local law, you keep that right. If you have a problem, please contact us first at hello@examgorilla.app so that we can try to fix it.
14. Changes to these terms#
We may update these terms, for example when we add features or when the law changes. We'll change the "Last updated" date. If a change is significant, we'll tell you in the app before it takes effect. If you keep using the app after a change takes effect, you accept the new terms. If you don't agree, you can stop using the app and cancel any subscription.
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
